Bloomberg reported that Johnson & Johnson is willing to pay more than $400 million to settle thousands of claims that the company sold defective artificial hips and hid the dangers of the devices from consumers.
In a December 9 court filing, a judge said that Johnson & Johnson has settled or is in the process of settling about 3,300 of the 10,000 lawsuits that have been filed against it regarding adverse events associated with its Pinnacle line of hip-replacement devices.
Sources who were familiar with the settlement, but spoke on the condition of anonymity, said that J&J executives have agreed to pay an average of $125,000 per case to resolve about one third of the Pinnacle suits that are currently pending against the company for a total payout of about $413 million.
The sources also said that J&J is seeking to resolve the remaining Pinnacle cases before a trial is scheduled to begin in Dallas on January 14, 2019.
These are the first settlements in this seven-year litigation over Johnson & Johnson’s Pinnacle hip implants, which plaintiffs say failed prematurely or gave them metal poisoning. Over the past two years, juries have awarded at least $1.7 billion in damages in cases related to Pinnacle hip implants.
In August, a Texas judge awarded $246.1 million for plaintiffs in the bellwether case after a jury ruled in their favor, finding J&J liable for the defects and fraud. The six plaintiffs in the case claimed that after implantation, the devices led to injuries including tissue death, bone erosion, and other negative health effects. The plaintiffs also claimed that J&J falsely promoted the device with claims that the implants would last longer than those that were made of plastic or ceramic.
In December 2016, a federal jury in Dallas awarded J&J and DePuy Orthopedics to pay more than $1 billion to six plaintiffs who claimed to be injured by its Pinnacle metal-on-metal hip implants.

I too almost died last year from septis terrible infection and hip had to be revisited. They have no conscience the surgeon that implanted the hip was a speaker for J&J making a fortune. Been a hell of a ride for 10 years until the metal was removed.
They been dragging this out for this reason .the longer we wait for them is in their favorite. Some or 30 to 40 percent of the people are old and tired of waiting. They keep appealing to prolong.paying. hang in there their going to pay we waited 6 years we can wait 5 more years.They are guilty they know it people and companys with plenty of money never want to pay.like I said we waited this long without any money from them we can wait till the end
At least Americans are getting some action which is not the case in Australia. I also have had revision done and was only one of the things found. Have now been left worse off and no one in Australia wants to know anything about it. Probably hope we die soon and j & j and deputy can then be let off the hook. Wish I had got an SSR and not a pinnacle as all my symptoms were the same and then at least I would have been recognised here. Out therapeutic goods administration pinnacles have caused no more problem then is considered acceptable.
I agree this peanuts. We deserve much more from incondersiderat jerks. It has been hell on earth from suffering from pain steming from hip replacement. After revision I have to live pain the rest of my life.
Stall, deny and hope they die! Motto of J&J DePuy Orthopedics! Pinnacle MoM implanted Oct 2010 and revision surgery Jun 2017. Almost immediately after orig. implant started feel dizzy and riddled w/pain. Tested positive for metallosis and had a MARS MRI in May 2017. MRI was a train wreck. When presented w/blood tests and MARS MRI report orig.ortho said I did not have metallosis, there was nothing wrong w/my hip and come back in a yr. Not! I went to another ortho who stated I did have metallosis, and the defective implant .required revision surgery “sooner” rather than later” $125,000 what a joke! I won’t consider anything less a 7 figure settlement I’ve endured over 8 yrs or pain and lies by a bunch of hacks in various disciplines, what a waste of time. I highly recommend some of these bad actors consider career changes. Don’t get on the wrong side of this Navy Chief who takes no prisoners. I’m also considering a medical malpractice lawsuit against the orig. ortho dud.
That’s pathetic, people deserve more than this for their pain and suffering. My father had this hip. He nearly died of metallosis. Since the faulty hip was removed he’s had 3 more, but because of the depuy hip and infection they failed as well. Since this all started he hasn’t been healthy enough to come home from the hospital for more than a week before another complication.
Now, just 2 days ago, my 75 year old father had to have his leg amputated because of everything that nasty hip caused. And they’re still fighting the infection.
My heart truly goes out to everyone that’s been through hell and back because of that implant.
I had the pinnacle hip for a while when it started squeaking when I walked. The revision found major tissue damage, blood poisoning and had ate the femor bone. It also caused damage to my back and other hip.That was 6 years ago and it still hurts. Something

My wife stayed in hospital from oct-dec, with no hip in ,just a spacer, came home and layed in bed for 10 more weeks without hip, because she got Mercer from hip surgery. Still can’t walk right, 5 revisions on hip.j&j owe her big bucks!
My medical lien I’m sure is over 450,000 plus 40 percent to lawyer , a percentage to trial lawyer , not sure what that will be. So 125.000 hell in my case the lawyer doesn’t even make anything, that’s in heard of. I had to live in a nursery home. Why hasn’t the appeals court in California making a decision ????

The question I have is: Why can’t the press be brought in on this case of a major corporation shirking its public duty and responsibility? With enough press coverage, the stockholders of J&J should be shamed in public and then demand their company do right by the thousands of us who have been harmed.

I am amazed that J and J can turn their back on suffering everyday and no recourse for their personal appeals…where is justice ??? They are obviously guilty and implied premedataded knowledge of wrongful marketing and skeptical safeness of material in a body. Comments from my doctor were”you are young, this material will last longer” of course no comment on it can kill you too. I have a 197.00 UCG per liter of cobalt in blood. How do you think the metals effect my systematically, early stages of hearing loss and COPD, plus pulled my 12 year old and only daughter through repurcutions of possible catastrpophic surgery??? I’m suffering since this faulty garbage has been put in my body! I’m also allergic to the medal in these! Two both hips, revisions pain breathing issues I never had before! They used us without our knowledge that these were faulty to begin with they claimed they were 100% titanium they are not and I’m allergic to them, therefore I struggle to breathe everyday! I don’t sleep more than 2 hours a day because of hip pain like a tooth ache! They can’t pay me enough for all this!!
My wife passed away after 8 years and 13 surgeries on her hip infection killer her. I’ve been waiting six years. Because they have so much money they think they don’t have to pay. I’ll be here to fight it so will my children I hope the best for all of you
I had my rt hip replaced 9/28/2017. I have had severe pain in my groin area of my right leg. My doctor retired but other doctors it’s just takes time to heal. It’s a Johnson and Johnson. Please help.
Both hips (. Still on metal dupuys) replaced in 2010 cardiac arythmia started in 2015 . Heart cath and full w/u no cause found other than metalosis ! Revision of both hips 2years apart post op complications leading to dead legs – wheelchair ! Better increase offer 6 fold !

I live in pain everyday of my life. Still have to work and drive and at no time am I not in some kind of pain and discomfort. Sleeping at not is not easy, walking, all of this after revision surgery. Their is not enough money in order to deal with this each day, each moment of our lives. But I will not let this define me…………..God is good and I know their is a plan for all of us, who have had to endure. Keep the faith my brothers and sisters. Keep living your lives.
I think it’s a shame that J&J can’t admit to their guilt putting these hips out on the market without approval from the FDA and to lie to the surgeons about these hips!! I had my replacement in 2011 and had to have it completely redone in 2012 whe my surgeon saw on an mri after going through terrible pain that I had infection in there plus had high levels of chromium and cobalt in my blood stream and have lost muscle from this and have no strength in my left hip and have constant pain everyday and have had to give up certain things in my life because of this!!
Just an update on my take from what is going on with the Pinnacle settlement. There was pretty much an uproar amongst the attorneys regarding the Bloomberg article published in early May. This precipitated a conference call by the MDL on Wednesday May 15th with roughly 1300 plaintiff attorneys. Right now there is quite a bit of dissent in the ranks of the attorneys involved regarding the “settlement” made by MDL 2244. Johnson and Johnson has chosen a scorched earth policy and seems to be willing to spend $100’s of millions fighting rather than to up the ante on their payout. The MDL is offering up each and every document from the Bellwether trials to anyone pursuing further litigation. This includes one-hundred-million pages of documents reviewed and more than 300 depositions.
This being said… Archer Systems, LLC out of Houston is the claims administrator and is currently going through all the medical liens in an attempt to settle. It is possible that by August they will be in a position to start offering individual payouts. Each of us knows that the result with be nothing but a disappointment. I have already told my attorney that I have suffered too much damage from metallosis to take what he thinks will be my take home. So….. call your attorneys and start bitching.
I am deteriorating rapidly health wise all beginning with revision surgery to correct one of two hips causing a pseudotumor and cobalt poisoning. I still need additional surgery on the other hip replacement but this time I may not make it. What is taking so long??
My Mother just passed away! she has had about 6 hip replacements, she got the blood virus( musha) if i spelled it right, we finally had to have the hips taken out because of the damage it created, she was bed bound foor the rest of her life, a wound that would never heal, now my mother is gone and this darn lawsuit is still ongoing, not once did we get a letter saying sorry for the hips and the pain you are going threw. from what the lawyer has told us that she was one of the worse cases he has ever seen, but with that said it has broke my family in every way that can be said and they still have not paid nothing, so with that said i am young and i have smalll kids that can keep this going to the end of times they will pay for what they did to my mother and family. and anything less then 100 million is a insult to me, they only thing i can pray for is that the ceo will have to have a hip replacement and they put a bad hip in him and let him see 1st had what all these people are or have gone threw

I had the first hip replacement at 66 now 83,can’t walk unassisted, can’t drive spend the day in a chair with large ice packs, 4 Vicodin a day, hysinglia, change ice packs 3 times a night,cancer spots, staph infections, unbelievable pain, every day a new symptom, these hip replacements were never tested and were continually used by the greedy medical profession! Will never hear a doctor say the word metallosisMy life has been shortened by the greed of the medical profession who seem to forget their oath!
